BOARD OF ADJUSTMENTS & APPEALS
The Board of Adjustments works in conjunction with the Planning Commission. The Planning Commission sets the standards for building in West Plains and from time to time, a citizen will request something that does not meet those standards. In this case, the citizen must make a formal request to the Board of Adjustments. An example of such a request would be when a citizen wants to build a garage on their house closer to the property line than city code allows. The decision of the Board of Adjustments is final and cannot be overturned except by the circuit court. An alternate route would be to request a change in the code from the Planning Commission and City Council.
Procedure: The Building Official will inform citizens when building plans require a decision by the Board of Adjustments. If the citizen wants to keep the plans as they are, he must file a Board of Adjustment hearing application with the Building Official. This Board also settles disputes over interpretation of code between the Building Official and citizens. The request should be made at least twenty days prior to the second Tuesday. The citizen is responsible for all direct costs associated with the request.
Criteria for Granting Variances (MO Supreme Court): Relief is necessary because of unique character of property rather than for personal considerations; applying strict letter of zoning ordinance would cause unnecessary hardship; imposition of hardship is not necessary for preservation of city's Comprehensive Plan; and granting of variance will result in substantial justice for all.
Meetings: Meetings are held only when there are citizen requests to be heard and will be noticed in the West Plains Daily Quill legal section. In addition, a sign is put up on the property and the notices are mailed to all property owners within 440'.Lastest Agenda
